3.3 Information Obtained from Third Parties
We may receive information from payment, hosting, and e-commerce service providers; shipping carriers; analytics, advertising, and fraud-prevention tools; social media platforms; artists, partners, or institutions; public sources; and individuals who purchase, recommend, or act on behalf of another person. The information received will depend on the interaction and the third party’s settings.
4. How We Use Information
We use information to operate, maintain, personalize, and improve the website and the Services; create and manage accounts, memberships, subscriptions, artist profiles, and catalogs; process orders, payments, commissions, billing, deliveries, returns, and refunds; evaluate artwork, artists, and proposals according to curatorial and professional criteria; and organize open calls, exhibitions, events, and collaboration opportunities.
We may display authorized profiles, biographies, artwork, prices, credits, and professional information on the website, in catalogs, on social media, and in press or promotional materials in accordance with the applicable agreements. We also use information to respond to inquiries, provide support, and send administrative or transactional notices.
We may use information to send news, invitations, and marketing communications while providing the option to unsubscribe; measure audience activity, performance, navigation, and the effectiveness of content or campaigns; protect accounts, artwork, intellectual property, users, and systems; detect fraud, abuse, unlawful activity, or security incidents; comply with legal, tax, accounting, contractual, regulatory, and record-retention obligations; establish, exercise, or defend legal claims; and conduct corporate reorganizations, audits, due diligence, or business transactions permitted by law.
5. Legal Bases, Where Applicable
When the European Economic Area’s General Data Protection Regulation (“GDPR”), United Kingdom law, or another regulation requires a legal basis, we process information, as applicable, to perform a contract or take pre-contractual steps; comply with a legal obligation; pursue proportionate legitimate interests, such as operating, protecting, analyzing, and improving the Services; protect vital interests; or on the basis of consent. You may withdraw your consent at any time without affecting the lawfulness of prior processing.
6. E-Commerce, Payments, and Shipping
Payments may be processed by independent service providers. SpaceArt Shop may receive payment confirmation, transaction identifiers, the billing name, payment method type, and the last digits of the payment method, but not necessarily the full card number. Service providers process information under their own notices and security requirements. To deliver artwork or products, we share the necessary information with artists or sellers, logistics providers, shipping carriers, insurers, customs brokers, or other parties involved in the delivery.
When an artist or seller ships an artwork directly to the buyer, both parties may receive the information strictly necessary to complete the transaction. They may not use that information for unrelated purposes, independent promotional activities, or unsolicited contact.
7. Artists, Sellers, and Public Content
SpaceArt Shop is a curatorial and commercial platform. Professional information, artwork images, and certain profile information provided for publication may be publicly visible and indexed by search engines. Artists must possess sufficient rights and authorizations for all submitted material. Removing content from the website does not guarantee its immediate removal from search engine copies, archives, previously distributed publications, or materials retained for legal reasons.
8. Cookies and Similar Technologies
We use or may use cookies that are strictly necessary for shopping cart functions, login, security, and preferences; functional cookies; analytics cookies; and, when implemented, advertising or campaign-measurement cookies. The availability of choices depends on the active technology and the applicable jurisdiction. When required by law, non-essential cookies will be activated only after consent is obtained.
You may configure your browser to block or delete cookies, although certain features may stop working. If SpaceArt Shop engages in activities considered a “sale,” “sharing,” or targeted advertising under applicable law, it will provide the required opt-out mechanism and process recognized signals, such as Global Privacy Control, when technically and legally applicable. A “Do Not Track” signal that is not legally binding may not receive a uniform response.
9. Marketing Communications
We may send promotional messages with your consent or when permitted by law. You may unsubscribe through the link included in the communication, by adjusting your preferences, or by writing to info@spaceartshop.com. Even after you unsubscribe, we may continue sending necessary communications concerning orders, accounts, security, legal changes, or ongoing relationships. An unsubscribe request may take the period permitted by law to become effective.
10. How We Disclose Information
We may disclose personal information, limited to what is necessary, to:
Service providers that host, maintain, or protect the website; process payments; or manage the online store, memberships, email, customer service, analytics, advertising, files, or databases.
Artists, sellers, buyers, curators, venues, organizers, shipping carriers, insurers, and partners when necessary for a requested purchase, delivery, exhibition, event, or collaboration.
Accountants, attorneys, auditors, consultants, and insurers subject to confidentiality obligations.
Authorities, courts, or other parties when required by law, a valid legal order, the protection of rights or safety, a fraud investigation, or the defense of legal claims.
A successor entity or counterparty in connection with a merger, sale, reorganization, financing, or transfer of assets, subject to reasonable protective measures.
Any third party authorized by you or acting according to your instructions.
SpaceArt Shop does not rent personal information lists. As of the effective date, SpaceArt Shop states that it does not sell personal information for monetary consideration. Certain advertising technologies, if used, could be considered a “sale,” “sharing,” or targeted advertising under broad legal definitions. In such cases, we will provide the notices and choices required by law.
11. Information Retention
We retain information for as long as reasonably necessary for the purposes described in this Policy, considering the duration of the account or membership, the performance and warranty of transactions, relationships with artists, tax and accounting obligations, fraud prevention, security, backup copies, statutes of limitation, and disputes.
Afterward, we securely delete, anonymize, or restrict the information unless continued retention is required by law. Deleting an account does not require us to delete transaction records, contracts, authorizations, provenance and authenticity records, billing information, or legal defense records that must be retained.
12. Security and Incident Response
We implement reasonable administrative, technical, and physical safeguards proportionate to the type of information and level of risk, including access restrictions, authentication practices, backups, updates, and the use of specialized service providers when appropriate. No system or Internet transmission can guarantee absolute security. You are responsible for protecting your credentials, using a unique password, and notifying us immediately of any unauthorized use.
When an incident triggers notification obligations, SpaceArt LLC will assess the incident and notify affected individuals and authorities in accordance with applicable law, including Florida law concerning the security of personal information.
13. International Transfers
SpaceArt LLC is established in the United States. If you access the Services from another country, your information may be transferred to and processed in the United States and other locations where service providers or transaction participants operate. When required by law, we will use recognized mechanisms and appropriate safeguards for international transfers. The laws and authorities in those countries may differ from those in your place of residence.
14. Your Rights and How to Exercise Them
Depending on your place of residence and the applicability of the law, you may have the right to confirm whether your information is being processed; request information about or access to it; correct or delete it; obtain a portable copy; restrict or object to processing; withdraw consent; opt out of the sale, sharing, targeted advertising, or certain profiling activities; appeal a decision; and not receive discriminatory treatment for exercising your rights.
Send your request to info@spaceartshop.com with the subject line “Privacy Request” and include your name, relationship with SpaceArt Shop, the right you wish to exercise, your jurisdiction, and sufficient information to locate the relevant records. To protect you, we may verify your identity and authority using proportionate information. An authorized agent must provide evidence of authorization, and we may also confirm the request directly with you. We will respond within the legally required period. We may deny or limit a request when permitted by law, explaining the reason and any available appeal process.
15. Supplemental Information by Jurisdiction
15.1 Florida Residents
SpaceArt LLC complies with applicable data-protection and incident-notification obligations under Florida law. Rights under the Florida Digital Bill of Rights will be provided to the extent that SpaceArt LLC is subject to that law. This Policy does not constitute an admission that the applicable statutory thresholds have been met.
15.2 California Residents and Residents of Other U.S. States
If a comprehensive state privacy law applies to SpaceArt LLC and your request, you may exercise the rights provided by that law. The categories described in Sections 3, 4, and 10 explain the information collected, the purposes for its collection and use, and its recipients. We do not use or disclose sensitive personal information to infer characteristics beyond permitted or necessary purposes. We will not discriminate against you for validly exercising your rights. This statement does not constitute an admission that SpaceArt LLC meets the applicability thresholds of any state law.
16. Children
The commercial Services are not directed to children under 13, and we do not knowingly collect personal information online from children under 13 without verifiable parental consent when required. Accounts, purchases, memberships, and contracts must be entered into by individuals with legal capacity or by their parent or authorized representative. SpaceArt may display or promote artwork by artists who are minors only under appropriate agreements and authorizations. If you believe that we have improperly received information from a child, please contact us so that we can investigate and delete it when appropriate.
17. Links, Social Media, and Third-Party Services
The website may contain third-party links, buttons, embedded content, or integrations. Their practices are governed by their own policies. SpaceArt Shop does not control or assume responsibility for their independent processing, security, or content. We recommend reviewing their notices before providing information.
18. Automated Decision-Making
We do not make decisions based solely on automated processing that produce legal or similarly significant effects on an individual, unless appropriate notice is provided and the required safeguards are made available. Automated tools may support security, fraud prevention, recommendations, classification, or analysis, subject to reasonable review and controls.
19. Changes to This Policy
We may update this Policy to reflect legal, technological, or operational changes. We will publish the revised version with a new “Last Updated” date and, when the change is material or required by law, provide additional notice and request consent. Changes will not be applied retroactively in a manner inconsistent with the law.
